FaxBase Terms of Service
Effective date: October 11, 2026
Last updated: October 11, 2026
These Terms of Service ("Terms") are a legal agreement between you and Contorta Development LLC ("Contorta," "we," "us," or "our") governing your access to and use of FaxBase, including our website and application at https://faxbase.contorta.dev and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who We Are
Contorta Development LLC is the entity responsible for FaxBase.
Mailing address: 77 W 4800 N Unit A202, Provo, UT 84604, United States
Contact: contact@contorta.dev
2. The Service
FaxBase lets you send faxes from documents you upload and, with a subscription, receive faxes at a dedicated U.S. fax number. We use third-party telecommunications and payment providers to deliver the Service. We may change, add, or remove features from time to time.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your sign-in credentials secure, and for all activity under your account. Tell us promptly if you suspect unauthorized use.
4. Acceptable Use
You agree not to use the Service to:
- send unsolicited advertising or marketing faxes, or otherwise violate the Telephone Consumer Protection Act, the Junk Fax Prevention Act, or similar laws;
- send content that is unlawful, fraudulent, harassing, threatening, defamatory, or that infringes anyone's rights;
- send malware or attempt to disrupt, probe, or gain unauthorized access to the Service or other users' accounts;
- resell or redistribute the Service without our written permission, or evade our billing rules or limits; or
- violate any applicable law or the rights of any person.
We may hold, block, or remove faxes and suspend or terminate accounts that we reasonably believe violate these Terms or put the Service or other people at risk.
5. Plans, Credits, and Billing
Plans. Plans and page-credit packages, their prices, and their page allowances are shown in the app at the time you purchase. Subscription fees are charged to your payment method at the start of each billing cycle through our payment processor, and your subscription renews until you cancel it.
Monthly pages and purchased credits. A subscription includes a monthly page allowance. Unused monthly pages expire at the end of the billing cycle and do not roll over. Purchased page credits do not expire. When you send a fax, monthly pages are used first and purchased credits afterward.
Pages. A fax's page count is determined from the document you send, including any cover page, and is calculated by us. Pages are counted when a fax is accepted for transmission.
Going over your allowance. If a fax would exceed your monthly pages and purchased credits:
- if the overage is small (currently under 10% of your monthly allowance), the fax is sent and the overage is recorded as a "strike," unless it is fully covered by your purchased credits, in which case no strike is recorded; and
- if the overage is larger, the fax is held until you add credits or change your plan.
Strikes and recovery. If you receive a second strike within a rolling 12-month period, your subscription is moved automatically at your next renewal to the next higher plan at that plan's price. For a recovery period, only the page allowance of your previous plan is usable; the remaining pages are reserved to recover the cost of your earlier overages. Recovery ends after a billing cycle in which you stay within your usable allowance. On the highest plan, continued overages may result in outgoing faxes being held. Voluntarily upgrading your plan clears a strike recorded in the current billing period.
Upgrades, downgrades, and cancellation. Upgrades take effect immediately and are charged at the full price difference, without proration. Downgrades take effect at your next renewal. You may cancel at any time; cancellation takes effect immediately and stops future charges. Your purchased page credits stay on your account, and you can keep using them to send faxes. Your fax number is held for a grace period (currently 30 days) in case you resubscribe, after which it is released and cannot be recovered.
Refunds. Except where required by law or stated otherwise at purchase, charges are non-refundable. Unused monthly allowances are not carried over. Purchased page credits are forfeited only if you delete your account; they remain available if you cancel your subscription or move to pay-as-you-go.
Taxes. Prices may be subject to applicable taxes, which will be shown or added at checkout where required.
6. Receiving Faxes
If you have a fax number, incoming faxes count toward your monthly allowance as described in the app. Very large incoming faxes (currently more than 100 pages or more than 25% of your monthly allowance) are held for your review before they are accepted; you may reject a limited number of them without charge, as shown in the app.
7. Delivery and Availability
Fax delivery depends on third-party networks and on the recipient's equipment, and we cannot guarantee that any fax will be delivered or received. The delivery status in the app reflects information reported to us by our telecommunications provider. If a fax fails to deliver, contact us and we will review whether pages should be restored to your account. We do not guarantee uninterrupted or error-free operation of the Service.
8. Your Content and Retention
You retain ownership of the content you send and receive. You give us permission to process, transmit, store, and display it as needed to provide the Service. You are responsible for your content and for having the rights and authority to send it. Fax documents are deleted after the retention period shown in your Settings (90 days by default), or sooner if you delete them. See our Privacy Policy for how we handle information.
9. Health Information
FaxBase does not currently claim to be HIPAA compliant and does not offer a business associate agreement. Do not use the Service to send or receive protected health information if you are subject to HIPAA.
10. Third-Party Services
The Service relies on third-party providers, including our platform, telecommunications, and payment providers, and may offer Google sign-in. Your use of those services may be subject to their own terms and policies.
11. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms, if your account is used unlawfully or abusively, or if we discontinue the Service. When you delete your account, your data is handled as described in our Privacy Policy, and any unused purchased page credits are forfeited.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY FAX WILL BE DELIVERED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTORTA AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless Contorta and its officers, employees, and service providers from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
15. Changes to the Service or These Terms
We may update these Terms from time to time. We will post the revised Terms with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Service after a change takes effect means you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles, except where applicable consumer-protection law requires otherwise. You and Contorta agree to the exclusive jurisdiction of the state and federal courts located in Utah for any dispute not otherwise resolved informally, except where applicable law requires a different venue.
17. Miscellaneous
These Terms and our Privacy Policy are the entire agreement between you and Contorta about the Service. If a provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
